Use of the Tracker is entirely voluntary. You are under no obligation to use, complete, or submit any tracking data as a condition of your participation in our programs or services.

Educational Purpose Only

The Tracker is provided solely as a self-monitoring and educational support tool. It is not a diagnostic instrument, clinical assessment, or medical device. Information logged in the Tracker—including but not limited to symptoms, bowel habits, sleep, mood, energy levels, food intake, and cycle data—is for your personal reference and to support conversation with your wellness practitioner. It does not constitute a clinical evaluation, and no entry or pattern identified through the Tracker should be interpreted as a diagnosis or medical opinion.

Voluntary Participation & No Obligation to Share

Your use of the Tracker is self-directed and voluntary at every stage. You choose what to log, how frequently to log, and whether to share any logged information with your practitioner or with Be Balanced by Micaela LLC. We will never require you to submit tracking data as a condition of receiving services. You may discontinue use of the Tracker at any time without affecting your enrollment or access to other services.

No Guarantee of Review or Response

While your practitioner may reference Tracker data during appointments if you choose to share it, Be Balanced by Micaela LLC does not guarantee that any submitted tracking information will be reviewed, acknowledged, or acted upon within any specific timeframe. The Tracker is not a substitute for direct communication with your practitioner and should not be used to report urgent or emergent health concerns. If you are experiencing a medical emergency, please call 911 or contact your physician immediately.

Limitation of Liability for Tracker Use

Be Balanced by Micaela LLC, its owners, practitioners, employees, and affiliates shall not be liable for any harm, injury, loss, or adverse outcome arising from your use of or reliance on the Tracker or any information logged within it. This includes, without limitation, any decisions you make regarding your diet, supplements, medications, physical activity, or medical care based on patterns or data observed through the Tracker.

You acknowledge and agree that: (a) use of the Tracker is at your sole risk and discretion; (b) the Tracker does not replace the advice of a licensed medical provider; (c) Be Balanced by Micaela LLC is not responsible for the accuracy, completeness, or interpretation of any data you enter; (d) no practitioner-patient or provider-client relationship is created or implied solely by your use of the Tracker; and (e) you will not use the Tracker as your sole or primary means of monitoring any medical condition.

Data & Privacy

Any information you voluntarily enter into the Tracker is subject to our Privacy Policy. We handle all logged health data with care and will not sell or share it with third parties without your written consent, except as required by law. As noted in Section 1, Be Balanced by Micaela LLC is not a HIPAA-covered entity, and Tracker data should not be considered protected health information under HIPAA. Please do not enter sensitive identifying medical records or data through any unencrypted platform or tool.

Certain features of our website, client portal, and tools — including wellness protocols, plans, summaries, and any chat or messaging assistant — may be generated or drafted, in whole or in part, using artificial intelligence and other automated systems. While a practitioner reviews protocol content before it is released to you, AI-assisted and automated output may contain errors, omissions, or inaccuracies and is provided for educational and informational purposes only. It is not medical advice, a diagnosis, or a treatment recommendation, and it does not replace consultation with a licensed healthcare provider.

You agree not to rely on any AI-assisted or automated content as a substitute for professional medical judgment, and you acknowledge that Be Balanced by Micaela LLC is not liable for any decision you make or action you take based on such content. Any chat or messaging assistant is not monitored in real time, is not a crisis or emergency service, and must never be used to report urgent or emergent health concerns. Our website, client portal, tracker, and related software (collectively, the "Platform") are provided on an "as is" and "as available" basis. We do not warrant that the Platform will be uninterrupted, timely, secure, error-free, or free of bugs, viruses, or other harmful components, and we may modify, suspend, or discontinue any part of the Platform at any time without notice.

Access to the client portal and tracker may be provided through personal login links, magic links, or other access credentials sent to you. These links and credentials are personal to you and grant access to your information. You are responsible for keeping them confidential and for securing any device through which you access the Platform.

Do not share your access links or credentials with anyone, and avoid accessing the Platform on a shared, public, or unsecured device. You are responsible for all activity that occurs through your access links or credentials, and Be Balanced by Micaela LLC is not liable for any unauthorized access to your account or information resulting from your failure to safeguard them or your device. Please notify us promptly if you believe your access has been lost or compromised.

The Platform is built on and depends upon third-party service providers and infrastructure, including but not limited to hosting, data storage, database, email delivery, and artificial-intelligence providers.
